The ex-lawyer for the former president has resigned as the US Attorney for New Jersey. This follows a judicial decision that challenged her right to serve.

The head of the Justice Department, the Attorney General, announced the prosecutor's departure on Monday. In a statement that the judicial decision made it unworkable for her to effectively run her office.

"Let no one confuse compliance for surrender," Habba stated. "The effort will now extend throughout America."

Habba's exit comes a week after a US appeals court ruled that she had been unlawfully serving as the top prosecutor. This ruling is likely to affect numerous prosecutions in New Jersey.

The appellate judges declared that a temporary posting that did not receive confirmation by the US Senate breached the federal law governing appointments.

The Attorney General added that the former prosecutor will stay on at the Department of Justice as a senior adviser. Habba plans to seek further review of the court's action, with hopes of a overturned decision.

On a social media platform, she wrote that the court "cannot be permitted to override the executive's selection of lawyers entrusted with carrying out the fundamental role of the presidency of enforcing the law."

She praised her tenure and pointed out that under her leadership, the city of Newark saw a one-fifth decrease in offenses. Additionally that the southern city of Camden had its first summer in 50 years with no murders.

Background and Previous Role

Habba, 41, first joined Trump's personal legal team in 2021. Subsequently, she acted for the former president in his hush-money trial in 2024, when he was guilty verdict on dozens of charges of document fraud.

Before her appointment to the federal prosecutor position, Trump had announced he was appointing her as his senior adviser in a potential future term, labeling her as a steadfast ally and a dedicated fighter for justice.
